1. Purpose
These Terms of Use govern the use of Prevox (mobile app + prevox.health website). By creating an account, you accept these terms.
2. Registration and account
- You must be at least 16 years old.
- You provide accurate information and keep your password confidential.
- You are responsible for any action carried out from your account.
- Prevox may suspend an account in case of fraudulent or abusive use.
3. Nature of the service
Prevox is a health prevention and personal medical record management tool. Prevox is not a medical device within the meaning of EU Regulation 2017/745 (unless explicitly stated otherwise). Prevox does not provide diagnoses and does not replace medical advice.
4. Important, emergencies
In a life-threatening emergency, call 15 (SAMU), 18 (firefighters) or 112 (European emergency number) immediately. Prevox is not an emergency service.
5. Pro Mode for doctors
- Pro Mode is reserved for healthcare professionals.
- Signing up to Pro Mode requires a verifiable professional identifier (RPPS, ADELI or national equivalent).
- Pro Mode is free for doctors. No fixed term commitment.
- The doctor agrees to access only patient records that have been explicitly shared with them.
6. Record sharing
- You alone decide who can access your record, for what purpose, and for how long.
- You may revoke a share at any time, without justification.
- Every access is logged, so you can verify who viewed what and when.
- Revoking a share cryptographically destroys the doctor's access (workstream K).
7. Prevox recovery (Shamir escrow)
You may activate Prevox recovery, which encrypts your DEK into 5 shares, of which 3 are sufficient to reconstruct. The 5 holders are independent (founder, cofounder, notary, FR bank, non-EU bank). The recovery procedure requires your identification and the agreement of at least 3 holders.
8. Intellectual property
Your personal data belongs to you. You grant Prevox a non-exclusive and limited licence to host and process it for the purposes listed in the privacy policy. The source code, the Ophamir algorithms and the Prevox visual identity remain the property of Prevox SAS.
9. Service availability
Prevox targets 99.5% availability. Technical interruptions may occur for maintenance or force majeure reasons. No compensation is due for interruptions of less than 8 consecutive hours.
10. Liability
- Prevox undertakes to secure your data with state-of-the-art cryptography (see privacy policy, section 7).
- Prevox cannot be held liable for damages resulting from unauthorised access linked to a weak password chosen by you, or from a leak outside our infrastructure (e.g. unlocked stolen smartphone).
- The total liability of Prevox is capped, in accordance with article L221-15 of the French Consumer Code, at the total amount paid by the user during the 12 months preceding the claim. For patients (free service), this cap is set at a symbolic 100 EUR.
11. Personal data
The processing of your data is detailed in our privacy policy. You have the rights of access, rectification, objection, erasure and portability (GDPR).
12. Updates to these Terms
Any material change will be notified to you 30 days before entry into force. Your continued use constitutes acceptance.
13. Governing law and jurisdiction
These Terms of Use are governed by French law. In case of dispute, and after an attempt at amicable resolution, the French courts shall have exclusive jurisdiction.
